ARTICLE 2. ACCESS TO SKI LIFTS
Lift Passes provide access to the ski lifts operated by SCV.
However, some ski lifts may be closed, with or without prior notice, in particular for weather, snow, or health-related reasons. SCV does not guarantee the daily opening of all ski lifts it operates.
Access restrictions may apply to certain ski lifts, for example due to the User’s age, physical condition, or equipment. These restrictions can be consulted at SCV Points of Sale, on the website https://www.serrechevalier-pass.com/ (hereinafter the “Website”), and at the boarding area of each ski lift. It is the User’s responsibility to ensure that they are not subject to any access restriction. Any User subject to such a restriction will be refused access to the relevant ski lift, and neither the User nor the person who purchased the Lift Pass used by that User shall be entitled to any compensation.
Access to a ski lift with a mountain bike (MTB) is only permitted if the following conditions are met:
- The MTB is included in the list of vehicles authorized by the regulations displayed at the departure point of the ski lift. It is specified, however, that mountain biking is prohibited in winter on ski slopes accessible via ski lifts;
- The User holds a Lift Pass allowing access to ski lifts with an MTB. It is specified that “Pedestrian” Lift Passes issued for the winter season, as well as for the summer season, do not allow access to ski lifts with an MTB.
Access to ski lifts with a “pedestrian” Lift Pass is only permitted if the User is not carrying any transport equipment (skis, snowboard, sled, MTB, scooter, etc.), even when held by hand.
Lift Passes do not grant Users any priority access to any ski lift. By exception, if the User benefits from the “Enjoy” option, they are entitled to priority access to the following ski lifts: the Pontillas, Prorel, and Ratier gondolas; the detachable chairlifts Bâchas, Bletonnet, Casse du Bœuf, Cibouit Clôt Gauthier, Combes, Côte Chevalier, Croix de la Nore, Cucumelle, Eychauda, Forêt, Grand Serre, Orée du Bois, Prorel, Rocher Blanc, and Vallons; and the Yrêt chairlift. Holders of a “Mobilité Inclusion” card (with “priority” designation) or a ski instructor professional card also benefit from priority access to ski lifts.
In order to facilitate the transmission of encoded information when the User passes through the ski lift access gates, the Lift Pass must be worn on the left side and preferably kept away from any mobile phone, keys, or any metal (aluminum) objects.
Minor Users who are not emancipated must be constantly accompanied by an adult, who must supervise them at all times.
ARTICLE 3. PARTICIPATION IN ACTIVITIES
The “Mountain Kart” Activity (offered in summer only) is open exclusively to Users who are at least 1.40 meters tall. The “Deval’Bob” Activity is open in winter only to Users aged 12 years or older. The “downhill scooter” and “guided electric scooter adventure” Activities (offered in summer only) are open only to Users who are at least 1.40 meters tall, and at least 14 years old for the electric scooter. For the “giant zip line” Activity, the User’s weight, or the total weight of two Users using the same zip line simultaneously, must be between 25 kg and 120 kg, with a maximum weight difference of 40 kg between the two Users.
Wearing a helmet is mandatory for all Activities.
Participation in an Activity involving the provision of equipment to the User (e.g., scooter, helmet, knee pads, elbow pads) may be subject to the presentation of proof of identity. This document will be returned once the equipment has been returned in good condition at the end of the Activity. If the equipment is not returned or is not returned in good condition, SCV reserves the right to take appropriate action against the User.
Equipment provided as part of an Activity may only be used on routes specifically designated for that Activity.
Minor Users who are not emancipated must be constantly accompanied by an adult, who must supervise them at all times.
ARTICLE 4. COMPLIANCE WITH RULES
The User must comply with the regulations displayed at the departure points of the ski lifts operated by SCV, as well as with any instructions given by SCV staff when using these lifts. The User is also advised to follow the “Ten Rules for the Conduct of Skiers and Snowboarders” issued by the International Ski Federation.
The User must comply with the health regulations established by the public authorities or by SCV in application of a decision by the public authorities. Where applicable, the health protocol is displayed at SCV Points of Sale and on the Website.
The User must refrain from any behavior that may harm or is likely to harm the safety, health, or comfort of other users, SCV staff, and SCV subcontractors (such as intoxication, verbal or physical abuse, consumption of tobacco, alcohol, or drugs, vaping, carrying weapons, shouting, use of devices producing excessive noise, pushing, cutting in line, etc.) in the departure and arrival areas of the ski lifts operated by SCV, as well as on the lifts themselves. The User must also refrain from damaging the equipment operated by SCV.
Failing this, SCV reserves the right to deny the User access to the ski lifts it operates, to inform any territorially competent judicial police officer, and to initiate any legal proceedings against the User.
ARTICLE 5. CONTROL
The User must be able to present to any authorized inspector:
- An original Lift Pass, valid and allowing access to the ski lift being used, in their name if it is a named Lift Pass;
- Where applicable, the original document(s) proving eligibility for a reduced or free rate for a Lift Pass or an Activity.
In the event of a discrepancy between the information physically displayed on the card on which the Lift Pass is encoded and the information stored in the chip, the latter shall prevail.
If the above-mentioned documents are not presented, the User must pay the price of the Lift Pass required to access the ski lift used and/or the price of the Activity.
In the event of an inspection by an authorized inspector and the identification of an infringement, the User must also pay a fixed penalty equal to five times the value of a daily Lift Pass. This amount is rounded up to the nearest euro.
If the User is unable or unwilling to pay the fixed penalty immediately, the authorized inspector will issue a official report of the offence. The inspector is then entitled to record the User’s identity and address. If the User refuses or is unable to prove their identity, the inspector shall immediately inform a territorially competent judicial police officer, who may require that the User be presented without delay. This procedure is immediately terminated if the User pays all the amounts due as part of the settlement. The User then has a period of three months from the date of the offence to pay the settlement amount, including any sum corresponding to the price of the Lift Pass, the fixed penalty, and administrative processing fees. Within the same period, the User may also submit a reasoned objection to SCV. If payment is not made within the aforementioned time limit and no objection is lodged, the offence report is sent by SCV to the public prosecutor and the User automatically becomes liable for an increased fixed fine collected by the French Public Treasury.
An authorized inspector may confiscate a Lift Pass belonging to a third party if it is being used by the User, in order to return it to its rightful holder.
The fixed penalty is not due in the event of failure to present booking confirmation for an Activity.
ARTICLE 6. NON-TRANSFERABILITY OF LIFT PASSES AND ACTIVITY ACCESS PASSES
Lift Passes and Activity access passes are personal and may not be transferred, whether for consideration or free of charge, to any third party. Any Lift Pass or Activity access pass that has been transferred in this way shall be considered invalid.
By exception, the non-nominative Lift Pass of the shortest duration and purchased at the highest price may be transferred. However, the new holder of the Lift Pass must meet the conditions set by SCV (including age requirements) to benefit from this Lift Pass. If the transferred Lift Pass includes the “Enjoy” option, this option shall also apply to its new holder.
ARTICLE 7. LOSS OR THEFT OF A CARD
In the event of loss or theft of the card on which their Lift Pass or Activity access right is encoded, and provided that this Lift Pass or Activity access right was purchased from SCV, the User must report the loss or theft at an SCV Point of Sale. The User must then provide:
- If the Lift Pass or Activity access right was purchased from SCV, the original proof of purchase. In the case of a purchase on the Website, the proof of purchase is the order confirmation email;
- If the Lift Pass or Activity access right was purchased from an SCV agent (distributor, travel agency, etc.), the number of the card on which the Lift Pass or Activity access right was encoded;
- The date of purchase of the Lift Pass or Activity access right;
- The payment method used for the purchase;
- The validity start date and duration of the Lift Pass or Activity access right.
A new Lift Pass or Activity access right will be encoded on a replacement card for the remaining validity period of the original Lift Pass or Activity access right. If the User had subscribed to the “Enjoy” option, this option will also be associated with the new Lift Pass.
The lost or stolen card is immediately deactivated and can no longer be used, even if it is later recovered.
For Lift Passes billed based on ski days used, such days will continue to be charged to the purchaser of the Lift Pass until the loss or theft is reported, regardless of whether the Lift Pass is used by its rightful holder or by a third party.
If the Lift Pass was purchased from an entity other than SCV or one of its agents, the User must report the loss or theft to that entity.
By exception, the following cannot be replaced:
- Lift Passes valid during the winter season with a remaining validity period of less than or equal to three hours;
- Activity access passes that have been fully used, even if such use was by someone other than the rightful holder;
- Activity access passes valid for one or more days during the summer season.
If the User has lost or had one of these passes stolen, they must purchase a new one. The User is advised to report the loss or theft to an SCV Point of Sale without delay so that the pass can be deactivated.
ARTICLE 8. DEFECTIVE CARD
Cards on which a Lift Pass or an Activity access pass is encoded must not be bent, pierced, broken, or placed near a source of heat.
In the event of a malfunction of a card, the User may return it to one of SCV’s Points of Sale. SCV will replace it free of charge.
If the card was issued by an entity other than SCV or one of its agents, the User must contact that entity to obtain a replacement.
